“User,” “you,” or “your” refers to any individual or entity accessing or using this Website.
2. Nature of Service
CabanaExperience.com provides information about cabana rentals and related services.
We do not process bookings directly on this Website. Users are redirected to our third-party booking partner, Booqable, at https://cabana-experience.booqable.com (“Booking Platform”) to complete their reservation.
3. Third-Party Bookings
All cabana rentals and add-on services are processed through a third-party booking and payment platform. While this software facilitates the transaction, your contract is directly with The Cabana Experience.
By proceeding with a reservation, you acknowledge and agree that:
- The Cabana Experience uses third-party software to manage bookings, payments, and cancellations.
- All customer service, rental setup, takedown, and equipment concerns are handled solely by The Cabana Experience.
- Cancellations must be made through the booking platform in accordance with our stated cancellation policy.
- Questions about your reservation, setup location, rental details, or day-of-service issues should be directed to The Cabana Experience, not the booking software provider.
4.Waiver Requirement for Equipment Use
To complete your reservation, you must acknowledge and agree to our liability waiver by checking the required box during the checkout process. This step is mandatory and your reservation cannot be submitted without it.
The waiver releases CabanaExperience.com and its affiliates from any liability related to the use of tents, chairs, coolers, or any other equipment provided during your rental.
5. Assumption of Risk
By using any beach equipment provided through our service or partners, you acknowledge and agree that outdoor activities carry inherent risks including weather, environmental hazards, physical injury, or equipment-related accidents.
You voluntarily assume all risk of injury, damage, or loss related to your rental and use of equipment.
6. Limitation of Liability
CabanaExperience.com is an informational and referral platform only.
We are not responsible for:
- The performance of third-party services
- Injuries, damages, or property loss arising from the use of rented equipment
- Errors or inaccuracies on the Booking Platform
Use of our Website and referral to third-party services is at your own risk.
7. User Responsibilities
You must review and accept the Booking Platform’s own Terms and Privacy Policy before reserving.
Any personal information shared during booking is managed by the Booking Platform, not by CabanaExperience.com.
8. Intellectual Property
All content on CabanaExperience.com—including text, photos, design elements, and branding—is protected by copyright and intellectual property laws.
You may not copy, reproduce, or distribute any content without our express written consent.
9. No Guarantees
We make no warranties, expressed or implied, about the accuracy or availability of content, services, or third-party platforms.

10. Indemnification

Our failure to enforce any provision of these Terms shall not constitute a waiver of our rights to enforce such provisions in the future.

15. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
16. Cancellations and Refunds
To cancel your reservation, you must use your Booqable account. Cancellations submitted by email or phone are not valid.
Cancellations must be made by 12:00 AM (midnight) the day before your scheduled setup in order to receive a full refund minus the non-refundable security deposit.
For example, if your rental is scheduled for 10:00 AM on July 15, you must cancel by 12:00 AM on July 14.
- Cancellations before the deadline: Full refund minus the security deposit.
- Cancellations after the deadline: No refund will be issued.
- Same-day cancellations or no-shows: Non-refundable.
- Weather-related cancellations: Refunds will only be issued if local authorities officially close the beach or for weather related cancellations for safety reasons before 1 pm.
